我國司法制度自清末變法開始全面革新，光緒二十八年間，清廷六部中的「刑部」改為「法部」，成為司法行政最高機關。民國建立以後，「法部」更改「司法部」。民國十七年，依五權分立原則，成立司法院，下設司法行政部，嗣於民國三十二年改隸行政院。六十九年七月一日，政府為了健全司法制度，明確釐清司法權與行政權的分際，乃實施審(法官)檢(檢察官)分隸制度，將原隸屬於司法行政部的高等法院以下各級法院改隸於司法院，將司法行政部改制為法務部，仍隸屬於行政院迄今。民國一○一年一月一日配合行政院組織改造，啟動本部新組織架構。
法務部的業務，關係民主法治的發展與人權公義的維護，是我國法務行政的主管機關，掌理全國檢察、矯正、司法保護、政風及行政院的法律事務。
所屬機關依業務性質分5大系統，一、檢察機關；二、調查機關；三、矯正機關；四、行政執行機關；五、廉政機構。分別負責打擊犯罪、為民眾伸張正義、矯正教化收容人、輔導更生人、保護犯罪被害人、推動廉政革新、提供法規諮商、執行公法上金錢債權等各項重要施政工作。
